tankly.ai offers a free tier and a paid "Pro" subscription. Subscriptions are processed through the Apple App Store, Google Play Store, or web payment providers via RevenueCat.
The Service includes AI-powered features that generate automated analysis, recommendations, identifications, care suggestions, and health-related insights. These features are powered by Google Gemini (Gemini API Terms of Service). These features are provided for informational, educational, and hobbyist purposes only.
tankly.ai is not a veterinary service and does not provide medical, veterinary, husbandry, or professional advice. Use of the Service does not create a veterinarian-client-patient relationship or any other professional relationship.
The Service is not intended to diagnose, treat, cure, or prevent any disease, illness, or condition affecting any animal, plant, or habitat. AI-generated outputs may be inaccurate, incomplete, outdated, or incorrect.
You acknowledge and agree that you are solely responsible for the care, health, safety, and wellbeing of your animals and habitats. Any decisions you make based on the Service are made at your own risk.
Always consult a licensed veterinarian or other qualified professional for any medical, health, illness, injury, or emergency concerns involving an animal.
The Service is not intended to engage in the practice of veterinary medicine as defined by any applicable state, federal, or international veterinary practice act, veterinary licensing law, or professional regulation. You are responsible for ensuring that your use of the Service complies with all laws and regulations in your jurisdiction.
We make no guarantees regarding animal health, survival, breeding success, environmental stability, or habitat outcomes resulting from use of the Service.
To the maximum extent permitted by law, tankly.ai shall not be liable for injury, illness, death of any animal, damage to habitats, loss of data, or any direct or indirect damages resulting from use of the Service or reliance on AI-generated content.
Nothing in the Service should be interpreted as veterinary diagnosis, treatment, or professional medical advice under any applicable Veterinary Practice Act.
AI features are experimental and provided "as is" without warranties of accuracy, reliability, or fitness for a particular purpose.
The Service is intended for hobbyist, educational, and informational use only. The Service is not intended for commercial breeding operations, veterinary practice, professional animal care services, or any regulated activity requiring a license.
AI-generated results are produced by automated systems and may be inaccurate, incomplete, or misleading. We do not guarantee the correctness, reliability, or suitability of any AI-generated output for any purpose.
The Service is not intended for emergency or critical use. The Service must not be used as a substitute for professional veterinary care, medical advice, or emergency services. If an animal is injured, ill, or in danger, contact a licensed veterinarian or appropriate professional immediately.
Your use of the Service is at your own risk. You assume full responsibility for any decisions made based on information provided by the Service, including AI-generated content, care recommendations, habitat settings, or species information.
You acknowledge that you are not relying on the Service for professional, medical, veterinary, or safety-critical decisions, and you agree that the Service is provided for informational purposes only.
We do not guarantee that any data stored within the Service will be preserved, available, or error-free. You are responsible for maintaining backups of important information. We are not liable for loss of data, corrupted data, or device-related issues resulting from use of the Service.
You are solely responsible for any content you create, upload, or store in the Service, as well as the care and handling of any animals, plants, or habitats referenced in the Service. We do not monitor or verify the accuracy of user-provided information.
You retain ownership of all content you create within the Service, including habitat data, pet profiles, care logs, and photos ("User Content"). By using the Service, you grant us a limited license to process your User Content solely to provide and improve the Service.
Most User Content is stored locally on your device and is not uploaded to our servers. Content submitted for AI analysis is transmitted securely and processed in real time.
The Service, including its design, code, graphics, logos, trademarks, and content (excluding User Content), is the property of tankly.ai and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
The Service may rely on third-party services, including AI providers, payment processors, analytics tools, and app store platforms. We are not responsible for the performance, accuracy, or availability of third-party services, and your use of such services is subject to their respective terms and policies.
Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
We may use anonymized and aggregated data to improve the Service.
The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 years of age.
If you are under 13, you may not use the Service or provide any personal information to us.
If we become aware that personal information has been collected from a child under 13 without verified parental consent, we will delete that information as soon as reasonably possible in accordance with the Children's Online Privacy Protection Act (COPPA).
Parents or legal guardians who believe that their child has provided personal information may contact us at legal@tanklyai.app to request removal of the data.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.
You agree to indemnify and hold harmless tankly.ai from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.
We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and may notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
We are not responsible for any failure or delay in performance of the Service due to events beyond our reasonable control, including but not limited to internet outages, service provider failures, natural disasters, acts of government, labor disputes, or failures of third-party services.
You agree not to use the Service in violation of any U.S. export control laws or regulations. The Service may not be used in any country or by any person prohibited under applicable export or trade laws.
You are responsible for ensuring that your use of the Service complies with all applicable local, state, federal, and international laws, including animal care regulations, veterinary practice laws, and data protection laws.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and tankly.ai regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the Service.
Failure by tankly.ai to enforce any provision of these Terms shall not be considered a waiver of our right to enforce that provision or any other provision at any time.
To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, and you agree to waive any right to participate in a class action lawsuit or class-wide arbitration, except where prohibited by law.
If you download or use the Service through the Apple App Store, Google Play Store, or any other third-party platform, you acknowledge that such platforms are not responsible for the Service.
tankly.ai, not Apple, Google, or any platform provider, is solely responsible for the Service, including support, maintenance, and any claims related to the Service.
Your use of the Service must also comply with the terms and policies of the applicable app store or platform through which the Service is distributed.
To the maximum extent permitted by law, app store providers shall have no warranty obligation, maintenance obligation, or liability related to the Service.
Apple and Google shall be considered third-party beneficiaries of these Terms and may enforce them.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
